Welcome to Sculpt Fitness Miami (“Sculpt,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of all services provided by Sculpt Fitness Miami, including but not limited to in-studio classes, online content, mobile applications, and our website located at http://sculptfitnessmia.com (“Site”). By using our services, booking classes, visiting the studio, or accessing our Site, you agree to be bound by these Terms and all applicable laws and regulations.

1. Eligibility

To use our services, you must be at least 18 years old or have the consent of a parent or legal guardian. You represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all the terms and conditions stated herein.

2. Health Disclaimer & Waiver of Liability

Participation in Sculpt Fitness classes involves physical activity that may pose health risks. By attending classes or using our facilities:

• You confirm that you are physically fit and have consulted with a physician regarding your ability to safely participate in exercise.
• You voluntarily assume all risks related to physical activity and waive any claim against Sculpt Fitness, its owners, employees, instructors, and contractors for any injury, illness, or damage that may result.
• Sculpt Fitness is not liable for injuries sustained during class, including those caused by improper form, equipment misuse, or underlying health conditions.

3. Class Booking & Cancellation Policy

Classes must be reserved in advance through our website, app, or third-party booking platform.

• You may cancel or reschedule your class without penalty up to 12 hours before the start time.
• Late cancellations and no-shows will result in a forfeited class credit or a fee, depending on your package or membership plan.
• Waitlist clients will be automatically enrolled in class once a spot opens. Standard cancellation rules still apply.

4. Membership Terms

Memberships are billed monthly and are non-transferable.

• Members must provide at least 30 days’ written notice prior to their next billing cycle to cancel or pause a membership.
• Sculpt reserves the right to change pricing, class offerings, and schedules. Notice of material changes will be provided via email or on our website.
• Refunds are not provided for unused sessions or time during a membership period unless otherwise required by law.

5. Package Expiration & Refund Policy

Class packs are non-refundable and have expiration dates stated at the time of purchase.

• Extensions may be granted for medical or emergency situations with supporting documentation and at Sculpt’s sole discretion.
• Refunds are not issued for dissatisfaction with services or scheduling conflicts.

6. Studio Policies

To maintain a safe and respectful environment for all members:

• Arrive at least 5 minutes before class. Late entry is not permitted once class begins.
• Grip socks are required for all classes.
• Phones must be silenced and stored during class.
• We reserve the right to refuse entry or remove any individual for disruptive, disrespectful, or unsafe behavior.
• All belongings are stored at your own risk. Sculpt is not responsible for lost or stolen items.

7. Account Creation & Security

When creating an account, you agree to provide accurate and complete information.

• You are responsible for maintaining the confidentiality of your login credentials and are liable for any activity under your account.

8. Intellectual Property

All content, branding, videos, audio, photography, trademarks, and instructional materials on our Site or in studio are owned by or licensed to Sculpt Fitness and may not be copied, reproduced, or used without our written permission.

9. Online & Virtual Services

If you access our classes or content online:

• You agree not to record, distribute, or republish any of our virtual workouts or materials.
• Online participation also assumes the same waiver of liability as in-studio classes.
• Internet connectivity and device compatibility are the responsibility of the user.

10. Privacy Policy

Our Privacy Policy, available [here], explains how we collect, use, and protect your information. By using our services, you consent to the data practices described in the Privacy Policy.

11. Termination

Sculpt reserves the right to suspend or terminate your access to services at any time, for any reason, including but not limited to violation of these Terms or conduct that we deem harmful to the studio or other clients.

12. Force Majeure

Sculpt shall not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, labor strikes, or failure of suppliers.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Florida. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of Miami-Dade County, Florida. By using our services, you consent to the jurisdiction of these courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page, and continued use of our services constitutes acceptance of the updated Terms.
